Eligibility for a partner’s pension

The surviving partner (of the opposite or same sex) of an insured person is entitled to a partner’s pension. All of the following conditions must be met for a pension claim to be established:

  1. The pension fund regulations of the insured person, provide a spouse’s pension.
  2. The partners can prove that they shared a joint household for an uninterrupted period of at least five years immediately before the insured person’s death or, at the time of the insured person’s death, they can prove that they shared a joint household and the surviving partner has to provide for a joint child.
  3. Neither partner was married or in a registered partnership at the time of the insured person's death.
  4. The partners are not related to each other in direct line of descent nor are they siblings or half-siblings (see Article 95 of the Swiss Civil Code).
  5. The surviving partner is not drawing a spouse’s or partner’s pension from a previous marriage, registered partnership or cohabitation and has not received capital benefits in substitution of such a pension.
  6. The form ‘Registration for a partner’s pension’ was completed in full and sent to the Foundation before the death and before retirement of the insured person.
